Nyako Impeachment: Confusion Looms as Soldiers Take over Home of Acting CJ
The move by the Adamawa State House of Assembly to impeach Governor Murtala Nyako seems to have assumed a new dimension following discovery that the tenure of the acting Chief Judge, Justice Ambrose Mammadi expires today (Sunday).
This is coming even as the action of the Mammadi in the constitution of a seven–man panel set was said to have been done as a result of pressure from certain quarters.
It was gathered that the Mammada has refused to constitute the panel citing reasons of the expiration of his tenure which ends today, forces from both within and outside the state forced him to set up the panel which is billed to be inaugurated tomorrow.
According to a reliable source, the chief judge was actually compelled to constitute the panel under duress.
Already, armed soldiers have taken over the residence of the Acting Chief Judge in a bid to get him to act on any others from above.
The armed soldiers were seen patrolling the street of the private residence of Mammadi, located at Masakare area of Jimeta, Yola, Adamawa State capital, yesterday.
The soldiers kept away strangers, vehicles and pedestrians from plying the street.
It was gathered that the seven-man investigation panel was selected and sent to the Acting Chief Judge by the House of Assembly for ratification and announcement.
Although, governor Nyako had publicly absolved the presidency from having a hand in his travail, suspicion of the Presidency’s involvement was fuelled by the no-love-lost relationship between President Goodluck Jonathan and Governor Murtala Nyako which came to its nexus when Nyako sent a memo to the Northern Governors’ Forum accusing Jonathan of carrying out genocide against northerners.
Since then, President Jonathan was said to have decided to ease Nyako out from office as the memo was said to have subjected the presidency to embarrassment and international ridicule.
According to a source, “the acting CJ had no choice but to carry out the ‘order from above’ and save himself from persistent intimidation and harassment from a Brigade Commander.
”What is happening is that they have made up their mind to strangulate everyone to ensure that Gov Nyako is thrown out and be arrested and treated as a common criminal for leaving PDP and joining APC and having the courage to speak out when it mattered.”
It was alleged that the panel is composed of five Christians and two Muslims, ostensibly to clear the deputy governor and cage the governor.
What is however throwing up the confusion is the fact that the tenure of the acting Chief Judge expires today and with the planned inauguration of the panel tomorrow, stakeholders in the state are waiting to see who will inaugurate the six-man panel that will pave the way for them to commence full impeachment move against the governor.
Already, sources from the Adamawa state Government house are saying any inauguration by the acting CJ is unconstitutional as his three months tenure will elapse today.
The Director of Press and Public Affairs to Governor Murtala Nyako, Mallam Ahmad Sajo when contacted over the issue said, the acting CJ can only inaugurate the panel in breach of the constitution as his tenure will elapsed today.
