Impeachment: Nyako Wins Round One as Court Strikes Out Lawmakers Suit
Adamawa state governor Murtala Nyako has won round on in the battle which by some members of the Adamwa State House of Assembly to impeach him and his deputy.
A Yola High Court sitting Monday dismissed an application brought before it by the Assembly seeking the court injunction to allow it serve Governor and his deputy impeachment notice through the media.
The lawmakers had gone to court to seek the injunction after several attempts by the clerk of the House, Mr. Francis Gbendenso to serve the governor the notice of impeachment as passed and directed by the house.
The governor and his deputy were said to have bolted from Yola the state capital to Abuja to evade the service of the impeachment notice.
The Acting Chief Judge of the state, Hon Justice, Ambrose Mammadi ruled that “In view of the holding of supreme court judgment in the case of Inikojo vs Adeleke to which I am bound I refused to exercise my discretion to grant the application sought by the House of Assembly
” I hold that service of the notice of allegation against the respondents must be personal service. I resolved the issue for determination in the negative. I refused the application, its accordingly dismissed”
