Ex-Kogi Gov Abubakar Audu Fires Back at EFCC, Says Its a Shameles, Lying and Attention-Seeking Agency
Barely 48 hours after the Economic and Financial Crimes Commission (EFFC),threatened to declare ex-Kogi State Governor, Prince Abubakar Audu wanted for allegedly evading arrest after its operatives stormed his Abuja residence, the former governor has come out to lampoon the ineptitude and failure of intelligence gathering in the agency which he described as shameless, liar and attention seeking.
Audu’s counsel, Mike Ozekhome,SAN in a letter to the Chairman of the EFCC, Ibrahim Lamorde today, a copy of which was obtained by iReports-ng.com said the former governor has been out of the country for medical treatment 8 full days before the fake EFCC report which indicate that he evaded arrest.
Part of the letter reads: ”We act as solicitors to Prince Abubakar Audu (hereinafter referred to as “Our Client”) and we write you this letter on his behalf and instructions. We hereby acknowledge receipt of your letter No. CR:3000/EFCC/ABJ/ISOS/T.M.11/VOL.7/37 dated 11th December, 2012, inviting our Client to interview you on thursday 13th December, 2012, by 10:00am. This is to inform you that Prince Abubakar Audu is at present outside the shores of Nigeria, receiving medical treatment following a ghastly motor accident he was involved in on the 29th of September, 2012, along Abuja?Jos Road. He had legally travelled out of Nigeria through the Nnamdi Azikwe International airport as a free citizen of Nigeria on the 4th of December, 2012.
” As was heavily publicized in the Nigerian media, following the said motor accident, Prince Abubakar Audu had been immediately admitted briefly at the Deef Hospital Aso Drive, Maitama, Abuja, for first aid treatment before he was flown to a hospital in London for further intensive medical attention as an emergency case, after he had achieved some measure of stability.
“Prince Audu interrupted his medical treatment in London and returned to Nigeria in mid November, 2012, to give away his only daughter in marriage on 24th November, 2012. Thereafter, Prince Audu also received a Doctorate Degree of Administration (Honoris Causa) from the Igbinedion University, Okada, on the 1st of December, 2012, before traveling back to the United Kingdom on 4th December, 2012, to continue his medical treatment. The flurry of activities had exerted on him, the undue pressure and pains of his injuries. All these activities were widely covered by the National media. The Honorary Doctorate Degree was accorded live coverage by NTA, ITV and other television stations. It was a big ceremony that also featured the Sultan of Sokoto, a former president of Ghana and Director General of the Nigerian Customs Service, amongst others.
“Through out his over three weeks stay in Nigeria, the EFCC never invited him for a chat either by letter or phone call. How could he have run away from a purported “arrest” that he was not aware of and over which he was never invited? We want to categorically state that contrary to the false position put forward in the widely circulated statement issued by the Economic and Financial Crimes Commission (EFFC) and reported in virtually all Nigerian Newspapers of 12th December, 2012, and on internet, Prince Abubakar did not flee Nigeria to escape arrest upon your “storming” his house. EFCC is very well aware that its letter inviting our Client to interview you was only delivered to his Counsel at 8:00pm on 11th December, 2012, after EFCC had impugned his integrity by telling the whole world that he had escaped from justice. It is absurd and unfair to lie to the world he evaded an arrest that he was never aware of being already in the UK at least eight (8) days earlier.
“This deliberate falsehood which was accorded wide publicity in the print, electronic and internet media by the EFCC constitutes a shameless and ungodly dissemination of a diet of lies by a body seeking public attention and relevance. Prince Abubakar Audu who had been in Nigeria for well over four weeks after an interim hospitalization in London following a ghastly motor- accident did not escape and had no reason to escape EFCC’s arrest as he was already far away in London, having travelled since the 4th of December, 2012, through the Nnamdi Azikwe International Airport, Abuja.
” Prince Abubakar Audu is currently being prosecuted by the EFCC in charge No. KG/EFCC/1/2006: FRN VS. PRINCE AUDU ABUBAKAR, at the Kogi State High Court, Lokoja, presided over by the Hon. Justice S. T. Hussaini. Its counsel is Mr Rotimi Jacobs, SAN, while Chief Mike Ozekhome, SAN, is defending Prince Audu.
” On the 6th of June 2012, there was heated argument between both Counsel on Audu’s motion for stay of proceedings. The trial judge on the 12th of July, 2012, duly granted a stay of further proceedings pending the determination of Appeal No. CA/A/138C/2011 filed by Prince Audu at the Court of Appeal, Abuja, against certain decisions of the trial Judge. That Appeal is still extant and pending. The charges against Prince Audu before the said trial court in Lokoja are still extant and live as the EFCC has not withdrawn them. How then on earth, could EFCC have been attempting to arrest Prince Audu for the same alleged offences he is already being prosecuted for by the same EFCC and which are subjudice before the Court of Appeal and the Trial Court? For the records, Prince Audu had, since 2006, diligently attended court on all days that his trial came up. He has never for one day absented himself.
“For the avoidance of doubt, the appeal which the Supreme Court dismissed on 22nd November, 2012, had nothing whatsoever to do with the current EFCC trial that Prince Audu is undergoing. The Supreme Court case had risen from proceedings before Justice M. A Medupin, following a nolle prosequi entered by the then Attorney- General of Kogi state, Dr. J. A. M. Agbonika. Its dismissal does not in any way affect the live case pending before Justice S. T Hussaini of the Lokoja High Court and the Court of Appeal, Abuja, where the appeal is currently pending. Surely, EFCC must live according to its slogan that “No one is above the law”.
