Court Of Appeal Affirms Ayogu Eze As APC Guber Candidate For Enugu
The court of appeal has affirmed senator Ayogu Eze as the governorship candidate of All Progressives Congress for Saturday’s election in Enugu state.
The court set aside the judgement of the federal high court Abuja which ordered INEC to remove Eze’s name.
The unanimous judgment delivered by justice Abdul Aboki voided the federal high court’s decision on the ground that the suit brought by Ogara had become statute barred and not competent in law have been filed outside the mandatory 14 days stipulated by section 285 subsection 9 of the constitution.
It held that the suit filed by Ogara was caught by the 4th alteration of the 1999 constitution which makes it mandatory for all pre-election matters to be filed within 14 days.
In the instant case, George Ogara filed his case after 32 days.
